10b. Territory
Additional fees are also payable for the right to use the photographs (or reproductions, or adaptations of, or drawings therefrom, either in complete or in part, alone or in conjunction with any wording or drawings) for all known or anticipated territories other than the country of booking. In general the additional fees cover the right to use images for one year from the date of the booking, in the territory or territories agreed.
Agreed at any time after the time of booking.
11a. Usage
It is the client's responsibility to notify the agent and negotiate additional fees (including extensions of existing agreements) for any usage which may be required or anticipated subsequent to the time of the booking as per 6a.
11b. Territory
It is the client's responsibility to notify the agent and negotiate additional fees (including extensions of existing agreements) for any territory which may be required or anticipated subsequent to the time of the booking as per 6b.
12. Exclusion Fees
A special fee will be negotiated when the work is in conjunction with a product which precludes work for competing products. It is the client's responsibility to check whether conflicting work has been done. If a model advertises a product he/she is able to work for any competitor unless an exclusion fee is negotiated.
AGENCY FEES
13a. All bookings except Equity Contract TV Commercials
The agency charges a supplement of 15% on all hourly, half-daily, daily, usage and other fees. Both agency and model fees will be invoiced by the agent with the exception of travel costs which are paid direct to the model. Any agreed expenses will be added where appropriate.
13b. Equity Contract TV Commercials
The fee negotiated by the agent is the artist's fee from which the agency commission will be deducted at 15% of the invoice total. Agreed expenses will be deducted where appropriate.
14. Payment
On all invoices payment is required within 30 days of the dates of the invoice. New clients will be billed in advance. In all cases the person booking the model will be invoiced and solely responsible for payment, unless otherwise agreed at the time of the booking. In all cases payment can be made by cash, cheque or bank transfer.
We reserve the right to invoice the ultimate client (i.e designer/manufacturer/owner of the product in question). All fees are for the right to use images and once agreed, are payable whether or not the use is appropriated.
OTHER ITEMS
15. Cancellation
If a booking is cancelled by either client or model within one working day of the proposed starting time of the booking the full fee will be charged to the defaulting party unless the booking is re-arranged within 24 hours in which case half the fee will be charged.
If the booking is cancelled outside the one day period but within two working days of the starting time, then half the fee will be charged. In the case of bookings of more than two days' duration, if the booking is cancelled within a period equal to the length of the booking time, then the full fee will be charged - Saturdays, Sundays and Bank Holidays are excluded from these calculations.
This is a reciprocal arrangement between model and client.
16. Weather Permitting Bookings
If the client cancels less than 12 hours before the booking, a half fee is charged unless the client fails to cancel in time to prevent the model's attendance, when a full fee is charged. In the case of cancellation outside working hours (9am-6pm), the client must ensure that the model has received the cancellation, otherwise the booking will be held to be un-cancelled.
17. Lateness
If the model is more than a half-hour late for a booking (unless the client is warned of a reasonable cause prior to the time of booking) then a deduction of 50% of the hourly fee per additional half hour of lateness is made from the fees paid to the model - the client should notify the agent of this. In the case of public transport (train, bus or plane) causing the lateness, no fee will be charged unless the model misses the agreed scheduled train/bus/plane, in which case a R30 fine per train/bus/plane missed is deducted.
18. Items Taken to the Booking
Models should ensure that any items requested by the client at the time of booking should be brought to the booking. This should always include proof of age and identity (passport/birth certificate/drivers licence/other approved ID). Failure to produce any pre-arranged items without good cause will subject the model to a R80 deduction.
